Registration is done, the sale deed is signed, and you have the keys. Most buyers assume ownership is now complete. It isn't โ€” and the omission costs thousands of buyers their legal standing in government records every year.

Mutation (also called Dakhil Kharij, Name Transfer, or Property Transfer in different states) is the process of updating the municipal or revenue authority's records to reflect your name as the new owner. Without it, the previous owner remains on official records โ€” which creates problems when paying property tax, applying for utilities, selling the property, or dealing with any government authority.

What Mutation Is and What It Is Not

Mutation is NOT the same as registration. Registration of a sale deed with the Sub-Registrar creates legal title โ€” it's evidence that a transaction occurred. Mutation updates the revenue/municipal records to reflect the new owner for administrative purposes.

  • Registration: done with the Sub-Registrar's office, state revenue department
  • Mutation: done with the Municipal Corporation, Revenue Department, or Panchayat (depending on location)

Mutation does not by itself create ownership โ€” but without it, you won't be able to pay property tax in your name or get a building plan approved.

Why You Must Do It Promptly

Property Tax: Without mutation, property tax demand notices continue to come in the previous owner's name. Arrears from the previous owner's unpaid tax can be raised against the property (not just the person), affecting your future sale or mortgage.

Utility Connections: BESCOM (Karnataka), MSEDCL (Maharashtra), TANGEDCO (Tamil Nadu), and other state utilities require the property to be in your name for a new connection or name transfer.

Future Sale: When you sell the property, the buyer's bank will do a title check. Discrepancy between the sale deed (in your name) and revenue records (still in previous owner's name) raises red flags and can stall loan disbursement.

Inheritance and Partition: Mutation in your name establishes a clean chain for inheritance.

Process by State

Maharashtra (Dakhil Kharij / Mutation)

  • Apply online via the Maharashtra Revenue Department (mahabhulekh.maharashtra.gov.in) or at the District Tehsil office
  • Documents: Sale deed copy, 7/12 extract, property card, identity proof
  • Timeline: 30โ€“90 days
  • Fee: โ‚น500โ€“โ‚น2,000 depending on property value
  • Status can be tracked online on the Aaple Sarkar portal

Karnataka (Khata Transfer)

  • Apply to BBMP (Bruhat Bengaluru Mahanagara Palike) online or in person
  • Documents: Sale deed, previous owner's khata, property tax receipts, ID proof
  • Timeline: 30โ€“60 days
  • Fee: โ‚น200โ€“โ‚น600
  • Khata transfer is critical in Karnataka โ€” B-Khata properties (unauthorised buildings) cannot be transferred; verify the type first

Tamil Nadu (Patta Transfer)

  • Apply online at tnreginet.gov.in or at Taluk office
  • Documents: Sale deed, previous patta, encumbrance certificate, ID proof
  • Timeline: 30โ€“45 days after document verification
  • Fee: โ‚น250โ€“โ‚น1,000
  • Patta is the revenue ownership record; a patta in your name is essential for future sale

Telangana (Dharani)

  • Telangana has integrated registration and mutation via the Dharani portal (dharani.telangana.gov.in)
  • For land: mutation is largely automatic after registration
  • For apartments in gated communities: building permission records are with HMDA/GHMC โ€” name transfer applies there

Delhi

  • Apply to the Revenue Department (Delhi Revenue Department portal)
  • Documents: Sale deed, previous owner's property records, ID proof
  • Fee: โ‚น500โ€“โ‚น1,000
  • MCDs (North, South, East, Central Delhi) handle property tax mutation separately

Haryana (Gurugram)

  • Apply to the Revenue Department via the Jamabandi portal (jamabandi.nic.in)
  • Documents: Sale deed, jamabandi extract, ID proof
  • Timeline: 45โ€“90 days

Common Problems and How to Avoid Them

Previous owner's property tax arrears: Always demand a property tax clearance certificate from the seller before completing the purchase. Check for outstanding dues on the municipal corporation portal.

Delay by municipal authorities: Follow up proactively after submitting. Some states require a formal application followed by a field inspection โ€” the inspection is often where delays accumulate.

Incorrect name or details: Verify that the name in the mutation matches exactly with your Aadhaar, PAN, and sale deed. Mismatches cause rejection.

Not tracking status: Most states now have online status tracking โ€” use it rather than waiting for a physical intimation.

Practical Summary

File for mutation within 3 months of registration โ€” most states have no penalty for delay but some (like UP) impose a penalty for mutation filed after 6 months. Keep your sale deed and EC copies handy for the application. In Karnataka, confirm the khata type (A vs B) before purchase โ€” mutation of a B-Khata property signals an unauthorised structure. In Tamil Nadu, the patta is your most important revenue document โ€” get it updated before you need it, not when you're in a hurry to sell.

What to know

  • Without mutation, property tax notices keep arriving in the previous owner's name โ€” and their arrears can be raised against the property itself
  • Karnataka's B-Khata properties cannot be mutated into the new owner's name until the building is regularised
  • Telangana's Dharani portal largely automates mutation for land โ€” but apartment buyers in HMDA areas still need separate steps
  • Previous owner's property tax clearance certificate must be demanded before purchase โ€” not after

Registration creates your legal title. Mutation makes you visible to every government authority that will deal with your property โ€” without it, you own the asset but not the records.
